In the following text, Marco Fois is referred to as a company in plural (we, us and our).

Transparent handling of personal data is a very important concern for us. This privacy policy informs you about what personal data we collect for what purpose and with whom we share it. We regularly review and update this privacy policy to ensure the highest level of transparency.

What data we collect

General personal data

We process your general personal data. Personal data is any information that relates to an identifiable natural person. A natural person is identifiable if conclusions can be drawn about the identity of the person from the available information.

Example: Your name, IP address and home address are personal data.

Provided data

1. What do we do?

Marco Fois (Kanzleistrasse 17, 8004 Zurich) operates the website marcofois.ch (hereinafter referred to as we, us and our). On this website you can find out about our organization, use our online services and contact us.

The protection of your personal data is a great concern for us. In this privacy policy, we will inform you transparently and understandably about what data we collect about you through our website and how we handle it.

For this reason, we use the icons of the PRIVACY ICONSS association. They should help you to quickly get an overview of how we process your data.

3. Definition of terms

3.1 What is personal data?
Personal data (equivalent to the term „personal data“) is all information that relates to a specific or identifiable natural person. Data about personal preferences such as hobbies or memberships also counts as personal data.

3.2 What are special categories of personal data?

Special categories of personal data (equivalent to the term „particularly sensitive data“) are:

  • Data on health, privacy, ethnicity, sexual life and sexual orientation;
  • Data on administrative or criminal investigations and penalties, as well as data on social assistance measures;
  • Genetic data and biometric data that clearly identify a person.

If necessary and you provide us with this data yourself, we can process data that belongs to a special category of personal data. In this case, their processing is subject to stricter confidentiality.

3.3 What is the processing of personal data?
Processing (equivalent to the term „processing“) is any handling of personal data, regardless of the means and methods used, in particular the collection, storage, archiving, use, alteration, disclosure, archiving, deletion or destruction of personal data.

In some cases, it may be necessary for us to forward your inquiries to affiliated companies as part of order processing. Your data will also be treated confidentially in these cases.

6. Data subject rights

6.1 Right of access

You can request information about the personal data we have stored about you at any time. We ask you to send your request for information, together with a credible proof of identity, to beratung@marcofois.ch.

The information will be provided in writing or in another form, if possible also electronically. If you request it, we can also provide you with the information orally, provided that you can prove your identity in another way. If you submit your request for information electronically, we will provide the information in a common electronic format, unless you specify otherwise.

As a rule, the information is provided free of charge. If copies are requested in addition, a reasonable fee may be charged.

The right to receive a copy of the processed data must not infringe upon the rights and freedoms of other persons.

In the case of obviously unfounded or excessive requests for information, we reserve the right to refuse to provide information within the statutory limits or to charge a reasonable fee for it.

The processing of your request is subject to the statutory period of 30 days. We may extend this period by two further months due to the complexity and high number of requests, if this is necessary. You will be informed of the extension of the period within one month of submitting your request for information. At the same time, you will be given the reasons for the extension.

6.2 Deletion and rectification

You have the right to demand the deletion or rectification or completion of your data at any time, provided that there are no legal storage obligations or a legal justification to the contrary.

Please note that the exercise of your rights may conflict with contractual agreements and may have corresponding effects on the execution of the contract (e.g. premature termination of the contract or cost consequences).

6.3 Restriction of processing

You also have the right to demand that the processing of your data be restricted if you dispute the accuracy of the data, the processing is unlawful, the data is no longer required or you have objected to the processing.

If the processing of the data is restricted, the data may only be stored. Further processing may only be carried out with your consent, for the assertion, exercise or defense of legal claims, for the protection of the rights of another person or for reasons of an important public interest. If the restriction of processing is lifted, you will be notified.

6.4 Right to data portability

The competent supervisory authority in Switzerland is the Swiss Federal Data Protection and Information Commissioner.

7.1 What data do we process from you and from whom do we receive this data?

We primarily process personal data that you provide to us or that we collect when operating our website. In some cases, we may also receive personal data about you from third parties. This may include the following categories:

If, exceptionally, we are unable to comply with these principles, the data processing may nevertheless be lawful because there is a justification. Such justification may include:

  • the performance of a contract or pre-contractual measures;
  • compliance with legal requirements;

a. Principle

We may be dependent on using the services of third parties or affiliated companies and entrusting them with the processing of your data (so-called order processors). Categories of recipients include:

  • Accounting, fiduciary and auditing companies;
  • Consulting firms (legal advice, taxes, etc.);
  • IT service providers (web hosting, support, cloud services, website design, etc.);
  • Payment service providers (only after your prior consent);
  • Providers of tracking, conversion and advertising services.

We ensure that the data is passed on only with your express consent, unless it is not order processing. We also ensure that these third parties and our affiliated companies comply with data protection requirements and treat your personal data confidentially. Under certain circumstances, we may also be obliged to disclose your personal data to authorities.

b. Disclosure to partners and cooperation companies

We sometimes work together with different companies and partners who display their offers on our website. It is recognizable to you that it is a third-party offer (marked as „advertising“).

If you take advantage of such an offer, we will transmit your personal data to the corresponding partner or cooperation company (e.g., name, function, communication, etc.), whose offer you want to take advantage of, provided that you have expressly consented to this beforehand. c. Transfer abroad

If the level of data protection does not correspond to that of Switzerland, we will carry out a prior risk assessment and ensure contractually that the same protection is guaranteed as in Switzerland (e.g., by means of the new standard contractual clauses of the EU Commission or other measures prescribed by law). 7.5 How long do we store your data?

We store personal data only as long as necessary to fulfill the specific purposes for which the data was collected.

We store contract data for longer periods of time, as we are obliged to do so by law. In particular, we must keep business correspondence, concluded contracts and accounting documents for up to 10 years. Insofar as we no longer need such data from you to perform the services, the data will be restricted for further processing and we will only use it for accounting and tax purposes.

8. Data processing in detail

8.1 Providing the website and creating log files

If you simply visit marcofois.ch, i.e. do not register or provide any other information, only the data that your browser automatically transmits to our server is collected. This data is technically necessary for the operation of the website.

What data do we process?

How can you prevent data processing?
